Military Spouse Residency Relief Act - More $$ in your Pocket


Are you a Military Spouse? Are you stationed in a state outside of the state you claim residency of, solely because you have moved with your spouse? If so, we got good news for you! 

On November 1, 2009 the federal Military Spouses Residency Relief Act ,which amended the Servicemember Civil Relief Act (SCRA), was signed into law . The Act provides certain tax reliefs for military spouses who are present in a state solely to be with their servicemember when their servicemember is in that state on his or her military orders.  So the good news for you… you may be exempt from New York income tax on your earned wages (and NYC and Yonkers personal income tax)! Eligibility requires three factors. You are exempt from income tax by a state if:
1. Your spouse is a member of the armed forces present in New York in compliance with orders
2. You are present in New York solely to be with your spouse
3. You are a resident of another state

If you meet the above requirements and are working in New York, go to www.tax.state.ny.us and search for form IT-2104-E. After completing, give to your employer’s finance or HR representative. Employers may ask for you to provide proof of residency including but not limited to:
  • Ÿ Spouses military ID card
  • Ÿ A recent Leave and Earning Statement (LES)
  • Ÿ Voting registration
  • Ÿ Driver's license
